Jury begins deliberations in perjury, obstruction trial of Pennsylvania's attorney general

NORRISTOWN, Pa. (AP) — The Latest on the perjury and obstruction trial of Pennsylvania Attorney General Kathleen Kane (all times local):

A jury has begun deliberations in the perjury and obstruction trial of Pennsylvania's attorney general.
 
The jury got the case Monday afternoon.
 
Tonight on Channel 11 News at 5:55, WPXI’s George Colli will have the latest on today’s closing arguments and the case’s impact.
 
First-term Democrat Kathleen Kane is accused of leaking secret criminal files to the press to embarrass a rival prosecutor who dropped the case. Authorities say she also lied when she was called to testify before a grand jury.
 
Two former confidants testified against Kane. One said he conspired with her to leak the material and create a cover story.
 
Kane's lawyers question their credibility, but Montgomery County District Attorney Kevin Steele noted that she picked them to be her top aides.
 
The 50-year-old Kane had never before held office. She faces up to seven years in prison on the felony perjury charge. The other charges are misdemeanors.

Pennsylvania's Dem attorney general found guilty in perjury case

NORRISTOWN, Pa. –  The state's attorney general was convicted Monday of all nine counts in a perjury and obstruction case related to a grand jury leak.

Attorney General Kathleen Kane showed little emotion as jurors announced their verdict late Monday. The jurors agreed the first-term Democrat leaked information about a 2009 grand jury probe to embarrass a rival prosecutor.
Earlier, a lawyer for Kane in closing arguments blamed her former top aides for the leak of grand jury material, which found its way to a newspaper. Kane wanted the public to know her predecessor had failed to prosecute a case involving an NAACP official, but she never authorized the leak of secret criminal files, said her lawyer, Seth Farber.

Instead, he said, Kane's chief deputy, Adrian King, abused his power when he sent the files to a reporter through Kane's political consultant. King and the consultant, Josh Morrow, testified against Kane last week.
Morrow, who had a grant of immunity, said he and Kane devised a cover-up story that framed King for the leak. He acknowledged telling the lie to a grand jury.

"Those are two witnesses who will say whatever they need to in order to protect themselves," Farber said. "You would not even buy a used car from either one of them."

Montgomery County District Attorney Kevin Steele noted, though, that Kane had chosen the men as confidants. Text messages and phone records show frequent interactions among them on key days in the prosecution's timeline: when the documents changed hands, when the Philadelphia Daily News article appeared and when a grand jury started to investigate the leak.

A top deputy told the jury he was alarmed when he saw the June 2014 article. He testified Kane told him it was no big deal.  "Who would say that other than the person that is responsible for it?" Steele asked.

The leak grew out of Kane's feud with former office prosecutor Frank Fina, he said. According to trial testimony, Kane believed Fina had planted a story that showed she had dropped a statehouse sting.
"She was just hell-bent on getting back at Frank Fina," Morrow testified last week, describing Kane as "unhinged" at the time.

Kane did not testify or call any defense witnesses after three days of prosecution evidence. The jury began deliberations Monday afternoon.

Kane, 50, was once a rising star in the state's Democratic party, using her then-husband's trucking fortune to run for statewide office after stints as a Scranton prosecutor and a stay-at-home mother. But an early honeymoon period in office, when she spoke out for the legalization of gay marriage, was soon marred by turmoil as she sparred with officials inside and outside the office.

She staunchly described the charges as payback for her efforts to take on an "old-boys network" in state government that traded offensive, mildly pornographic emails. Her investigation led two state Supreme Court justices and others to resign.  However, the trial judge did not let her lawyers wade into that argument.

Public officials convicted of official misconduct in Pennsylvania typically don't have to resign until they are sentenced. Kane could stay in office while she appeals, the governor's office said.

Perjury, the only felony charged, can bring up to seven years in prison. The misdemeanor charges Kane faced included conspiracy, official oppression and false swearing.  Kane, the first Democrat and first woman elected to the office, lost her law license over the charges and did not seek re-election this year.

Pa. Attorney General Kane announces resignation after conviction on perjury, obstruction charges

Pennsylvania Attorney General Kathleen Kane announced Tuesday afternoon that she will resign from her position at the close of business Wednesday.
 
"I have been honored to serve the people of Pennsylvania and I wish them health and safety in all their days," Kane said in a statement.
 
A jury convicted her Monday night on all nine counts, including two felony perjury counts, obstruction and official oppression. Her lawyers say she will appeal.
 
In calling her a flight risk, the judge ordered Kane, 50, to surrender her passport and threatened to jail her if she retaliated against the once-trusted aides who testified against her.
 
Kane's political consultant, testifying with a grant of immunity, changed his grand jury testimony last week to tell jurors that he had "conspired" with Kane to leak grand jury material and then frame her chief deputy for the crime.
 
Perjury -- the only felony charge -- can bring up to seven years in prison. 
 
Bruce L. Castor Jr., who is Kane’s first deputy attorney general, will assume the role as the state’s top law enforcement official at the close of business Wednesday. Castor said he spoke with Kane prior to her decision and believes she made the right one. 
 
“I told her it would be very difficult to remain in light of the developments in Montgomery County,” Castor said on Tuesday. 
 
Several legislators from both sides of the political aisle also called on Kane to resign, and repeated calls for her resignation grew louder after her conviction.  
 
Pennsylvania Gov. Tom Wolf released the following statement after Kane's resignation:
 
“What has transpired with Attorney General Kane is unfortunate. Her decision to resign is the right one and will allow the people of Pennsylvania to finally move on from this situation. I have full faith and confidence in the employees of the Office of the Attorney General and know that they will continue to perform its most important functions including protecting consumers and prosecuting criminals. Moving forward, I will work with both Republicans and Democrats in the Senate regarding any potential appointment of an attorney general.”
 
Pennsylvania Auditor General Eugene DePasquale said, "I had called on (Kane) to resign previously. Obviously, the conviction doesn’t change that…I think she is making the right decision for the people of Pennsylvania."
 
Kane could have remained in office while appealing the conviction until her term expired in January because officials in Pennsylvania do not have to resign over misconduct until they are sentenced.

PHILADELPHIA — A once-rising star in Pennsylvania politics will learn Monday whether she is heading to prison over a feud that led the state attorney general to leak grand jury materials to the press and lie about it under oath.
Democrat Kathleen Kane, 50, argues that the loss of her career, law license and reputation is punishment enough. She has asked a judge in suburban Philadelphia to sentence her to probation or house arrest so she can be home to raise her two teenage sons.

However, prosecutors call her crimes “egregious” and will push for jail time. They say a paranoid Kane demeaned the 800-person office and threw the state's law enforcement community into turmoil through a calculated scheme to embarrass a rival prosecutor who had left the office.

Kane “repeatedly misused her official authority to advance her personal vendettas,” Montgomery County District Attorney Kevin Steele, a fellow Democrat, wrote in a sentencing memo last week.
Kane's fate will unfold in the same county where former President Bill Clinton had stumped for her in 2012, four years after Kane helped with Hillary Clinton's first presidential bid.

Kane enjoyed mostly good press early on as she supported gay marriage, ramped up a child predator unit run by her twin sister and questioned her predecessor's handling of the Penn State sex-assault case.
But turmoil inside the office became apparent as top deputies and career prosecutors headed for the doors. Kane's feud with one of them, Frank Fina, who had helped run the Penn State probe and other sensitive investigations, led to the leak.

Kane, taking aim at him, had her political consultant pass confidential files to a reporter about a corruption case Fina had declined to charge before he left the office. She then tried to frame someone else for the crime, former aides testified at the perjury and obstruction trial.

Kane did not testify at the August trial, when the jury convicted her on all nine counts before taking a meal break. Common Pleas Judge Wendy Demchick-Alloy sharply warned Kane afterward that she would put her in jail if she tried to retaliate against anyone. The sentence could range from probation to a maximum 24 years in prison.

Kane overcame a difficult childhood in Scranton to put herself through college and law school. She worked as an assistant county prosecutor before a stint as a stay-at-home mother and community volunteer. She then used $2.25 million of her husband's trucking fortune to run for attorney general. They are divorcing. Kane expects to get $6 million in the divorce, and receives nearly $350,000 a year in alimony and child support while living in the family's sprawling home in Clarks Summit, Lackawanna County, according to local news reports that cite court filings.

Aside from the conviction, Kane's political career will be remembered for her investigation of pornography that she said was being traded on state computers by judges, lawyers and other public employees. Two state Supreme Court justices resigned amid the fallout.

“She rose from poverty to a pinnacle, and has already fallen,” lawyer Mark Steinberg wrote in the defense sentencing memo. “She has been humbled and embarrassed, and now just wants to make amends and to focus her attention on raising her children.”

With any luck, her cellmate for the next 24 years, will look like this!
